Voluntary Disclosure: Coming Clean To Avoid Bigger Trouble
The IRS does distinguish between willful behavior and mistakes made in good faith. It also distinguishes between tax evaders who have to be hunted down and those who “come in from the cold.” The IRS has revamped its longstanding Voluntary Disclosure Practice, which allows delinquent filers or tax debtors to come into compliance. While the IRS does not guarantee it won’t prosecute, taxpayers who make a full disclosure and pay the arrears generally avoid criminal charges.
If accepted into Voluntary Disclosure, the filer agrees to pay a 75% civil fraud penalty for the year in which the highest tax burden was owed. That is a heavy penalty, but if criminally prosecuted, the penalty is 75% for each year taxes were not paid in addition to the presumptive prison sentence. If one knowingly defrauded the government, it’s a big gamble to hope the IRS never finds out.
